On February 3-4, 2003, the first Extra-Ordinary Summit of the Assembly of the African Union meeting in Addis Ababa, Ethiopia, adopted the historic Article 3(q) that officially,

“invite(s) and encourage(s) the full participation of Africans in the Diaspora in the building of the African Union in its capacity as an important part of our Continent.”

From this decision, the African Diaspora would become designated as the 6th Region of the African Union.”

The Article 3(q) Amendment to the AU Constitution was proposed by Senegal's President Abdoulaye Wade in an attempt to limit the Diaspora to expatriate Africans in order to reversE Africa's Brain Drain and turn it into Brain Gain. President Wade, whose family owned slaves and forced them into military service, opposed Reparations at the World Conference Against Racism and attempted to shield himself from paying reparations. The descendants of people trafficked from Africa and enslaved in the America's were to be left out of the African Union. A compromise was made and the African Union defined the Diaspora thusly:

The African Union definition is controversial and has attracted much criticisms. "The United States is guilty of state-sanctioned ethnocide," Baleka said, referring to the deliberate and systematic destruction of cultures. "We are the living victims of it, and for the first time in human history – because of the DNA testing – we can actually recover from the ethnocide."

The case relies on a growing body of research around epigenetics, which looks at the way environmental conditions impact gene expression and function.

According to Baleka, these epigenetic changes are the result of intentional processes honed during the era of enslavement. Repeated exposure to life-or-death situations caused Black people's genes to record the responses that allowed them to survive, which he said reinforced behaviors of obedience and subservience. To this day, these fear-based responses may be triggered when African Americans are exposed to similar environments of scarcity and danger.

"What we have learned all these generations is, instead of responding to our natural human tendencies, we have to disregard them and behave or perform as the object that we were created to be – these instruments that simply obey what the white man has said. How can we be fully human if that’s now our operating system?" Baleka asked.

"Literally, we are genetically no longer natural. We have an artificial genetic structure that was manufactured. It was created by this process, and it needs repair."

OUTCOME OF THE 3RD PREPARATORY MEETING OF THE 8TH PAN AFRICAN CONGRESS PART 1
“Others are becoming billionaires in Africa everyday. Later this year, the government of Zimbabwe will be hosting the “8th Pan African Congress Part 1 (8PAC1)”. DIASPORA PAN AFRICAN CAPITAL FUND
$100 a month from 1 million African Diasporans (0.4% of the African Diaspora population) is $100 million a month. That’s $1.2 billion a year and $6 billion in five years. Investment through the fund qualifies for citizenship through Pathway 1. At maturity, money is deposited in a bank in the country of choice.
Once again, more than 350 people attended and stayed for the 4 hour meeting, and after the meeting another 150 people stayed for another 3 hours of discussion!!!

On February 24, 2023, BBHAGSIA President Siphiwe Baleka joined lawyers, scholars and activists from around the world at the 𝟗𝐓𝐇 𝐀𝐍𝐍𝐔𝐀𝐋 𝐆𝐄𝐍𝐎𝐂𝐈𝐃𝐄 𝐀𝐍𝐃 𝐇𝐔𝐌𝐀𝐍 𝐑𝐈𝐆𝐇𝐓𝐒 𝐑𝐄𝐒𝐄𝐀𝐑𝐂𝐇 𝐂𝐎𝐍𝐅𝐄𝐑𝐄𝐍𝐂𝐄 held at Northeastern Illinois University in Chicago, IL. According to Mr. Baleka,

“While genocide has and is being committed against Afro Descendants in the United States, 𝐚𝐬 𝐚 𝐥𝐞𝐠𝐚𝐥 𝐬𝐭𝐫𝐚𝐭𝐞𝐠𝐲 𝐭𝐨 𝐬𝐞𝐜𝐮𝐫𝐞 𝐫𝐞𝐩𝐚𝐫𝐚𝐭𝐨𝐫𝐲 𝐣𝐮𝐬𝐭𝐢𝐜𝐞, 𝐠𝐞𝐧𝐨𝐜𝐢𝐝𝐞 𝐜𝐚𝐦𝐩𝐚𝐢𝐠𝐧𝐬 𝐡𝐚𝐯𝐞 𝐧𝐨𝐭 𝐬𝐮𝐜𝐜𝐞𝐞𝐝𝐞𝐝.
No case has yet been brought before the International Court of Justince (ICJ) on our behalf. However, due to new African Ancestry dna testing technology and genealogy research, it is now much easier to prove that ethnocide has been committed at both the individual and group level and this is generally accepted by the international community. The attached Mandate on behalf of 𝐀𝐋𝐋 𝐝𝐞𝐬𝐜𝐞𝐧𝐝𝐚𝐧𝐭𝐬 𝐨𝐟 𝐭𝐡𝐞 𝐩𝐞𝐨𝐩𝐥𝐞 𝐤𝐢𝐝𝐧𝐚𝐩𝐩𝐞𝐝, 𝐭𝐞𝐫𝐫𝐨𝐫𝐢𝐳𝐞𝐝, 𝐭𝐨𝐫𝐭𝐮𝐫𝐞𝐝 𝐚𝐧𝐝 𝐭𝐫𝐚𝐟𝐟𝐢𝐜𝐤𝐞𝐝 𝐟𝐫𝐨𝐦 𝐭𝐡𝐞𝐢𝐫 𝐡𝐨𝐦𝐞𝐥𝐚𝐧𝐝𝐬 𝐨𝐧 𝐭𝐡𝐞 𝐀𝐟𝐫𝐢𝐜𝐚𝐧 𝐜𝐨𝐧𝐭𝐢𝐧𝐞𝐧𝐭 𝐚𝐧𝐝 𝐞𝐧𝐬𝐥𝐚𝐯𝐞𝐝 𝐢𝐧 𝐭𝐡𝐞 𝐀𝐦𝐞𝐫𝐢𝐜𝐚𝐬 is being circulated for signatures and endorsements to instruct the newly formed Permanent Forum on People of African Descent (PFPAD) at the United Nations to request an advisory opinion from the International Court of Justice (ICJ). Such an opinion would provide 𝒍𝒆𝒈𝒂𝒍 𝒄𝒍𝒂𝒓𝒊𝒕𝒚 𝒇𝒐𝒓 𝒓𝒆𝒑𝒂𝒓𝒂𝒕𝒐𝒓𝒚 𝒋𝒖𝒔𝒕𝒊𝒄𝒆 𝒇𝒐𝒓 𝒂𝒍𝒍 𝑨𝒇𝒓𝒐 𝑫𝒆𝒔𝒄𝒆𝒏𝒅𝒂𝒏𝒕 𝒑𝒆𝒐𝒑𝒍𝒆. Prior to the PFPAD, we did not have access to the ICJ since only states could file a case. PFPAD has as its unique mandate, the right to request advisory opinions from the ICJ.

THIS IS WHAT MALCOLM X INTENDED TO DO WHEN HE SAID INTERNATIONALIZE OUR STRUGGLE, but the PFPAD didn't exist during Malcolm X's time (see below) and he was unable to get any government to bring a case before he was murdered.

On January 3, 2023 PFPAD President Epsy Campbell Bar sent a 𝑹𝒆𝒒𝒖𝒆𝒔𝒕 𝒕𝒐 𝑷𝒐𝒑𝒆 𝑭𝒓𝒂𝒏𝒄𝒊𝒔 𝒇𝒐𝒓 𝒕𝒉𝒆 𝑪𝒂𝒕𝒉𝒐𝒍𝒊𝒄 𝑪𝒉𝒖𝒓𝒄𝒉 𝒕𝒐 𝒔𝒆𝒆𝒌 𝒇𝒐𝒓𝒈𝒊𝒗𝒆𝒏𝒆𝒔𝒔, 𝒓𝒆𝒑𝒂𝒓𝒂𝒕𝒊𝒐𝒏 𝒂𝒏𝒅 𝒓𝒆𝒄𝒐𝒏𝒄𝒊𝒍𝒊𝒂𝒕𝒊𝒐𝒏 𝒘𝒊𝒕𝒉 𝒑𝒆𝒐𝒑𝒍𝒆𝒔 𝒐𝒇 𝑨𝒇𝒓𝒊𝒄𝒂𝒏 𝑫𝒆𝒔𝒄𝒆𝒏𝒕 𝒊𝒏 𝑨𝒎𝒆𝒓𝒊𝒄𝒂 𝒂𝒏𝒅 𝒕𝒉𝒆 𝑪𝒂𝒓𝒊𝒃𝒃𝒆𝒂𝒏 𝒕𝒐𝒘𝒂𝒓𝒅𝒔 𝒕𝒉𝒆 𝒑𝒂𝒕𝒉 𝒐𝒇 𝑯𝒖𝒎𝒂𝒏 𝑭𝒓𝒂𝒕𝒆𝒓𝒏𝒊𝒕𝒚. Indeed, this shows that PFPAD is wasting no time and is ready to take action on the inputs it receives from civil society. In President Bar’s letter, recognition was made of Kamm Howard who earlier this year delivered the PRESENTMENT TO THE HOLY SEE IN FURTHERANCE OF REPARATIONS, a document that concludes by stating,

“Compelled by international law, customs, and norms regarding redress for total war, war crimes, and crimes against humanity, and encouraged by the words and spirit of the 𝑬𝒏𝒄𝒚𝒄𝒍𝒊𝒄𝒂𝒍 𝑭𝒓𝒂𝒕𝒆𝒍𝒍𝒊 𝑻𝒖𝒕𝒕𝒊, in which Pope Francis calls for a deepened sense of our shared humanity, we seek full reparations and healing for people of African Ancestry. . . . Consequently, from all the above, the Holy Roman Catholic Church has a profound moral 𝒂𝒏𝒅 𝒍𝒆𝒈𝒂𝒍 𝒐𝒃𝒍𝒊𝒈𝒂𝒕𝒊𝒐𝒏 𝒐𝒇 𝒇𝒖𝒍𝒍 𝒓𝒆𝒑𝒂𝒓𝒂𝒕𝒊𝒐𝒏𝒔.”

The next step in pursuing reparatory justice and enforcing the legal obligation at the international level is requesting an advisory opinion from the International Court of Justice (ICJ).

𝐖𝐄 𝐔𝐑𝐆𝐄 𝐘𝐎𝐔 𝐓𝐎 𝐒𝐈𝐆𝐍 𝐓𝐇𝐄 𝐌𝐀𝐍𝐃𝐀𝐓𝐄 𝐀𝐍𝐃 𝐂𝐈𝐑𝐂𝐔𝐋𝐀𝐓𝐄 𝐈𝐓 𝐖𝐈𝐃𝐄𝐋𝐘 𝐓𝐎 𝐂𝐎𝐋𝐋𝐄𝐂𝐓 𝐓𝐄𝐍𝐒 𝐎𝐅 𝐓𝐇𝐎𝐔𝐒𝐀𝐍𝐃𝐒 𝐎𝐅 𝐒𝐈𝐆𝐍𝐀𝐓𝐔𝐑𝐄𝐒 𝐖𝐎𝐑𝐋𝐃𝐖𝐈𝐃𝐄 𝐁𝐘 𝐌𝐀𝐑𝐂𝐇 𝟑𝟏.

𝐌𝐚𝐥𝐜𝐨𝐥𝐦 𝐗'𝐬 𝐔𝐧𝐟𝐢𝐧𝐢𝐬𝐡𝐞𝐝 𝐁𝐮𝐬𝐢𝐧𝐞𝐬𝐬 - On May 21, 1964, Malcolm X stated,

“The American black man needed to recognize that 𝒉𝒆 𝒉𝒂𝒅 𝒂 𝒔𝒕𝒓𝒐𝒏𝒈, 𝒂𝒊𝒓𝒕𝒊𝒈𝒉𝒕 𝒄𝒂𝒔𝒆 𝒕𝒐 𝒕𝒂𝒌𝒆 𝒕𝒉𝒆 𝑼𝒏𝒊𝒕𝒆𝒅 𝑺𝒕𝒂𝒕𝒆𝒔 𝒃𝒆𝒇𝒐𝒓𝒆 𝒕𝒉𝒆 𝑼𝒏𝒊𝒕𝒆𝒅 𝑵𝒂𝒕𝒊𝒐𝒏𝒔 𝒐𝒏 𝒂 𝒇𝒐𝒓𝒎𝒂𝒍 𝒂𝒄𝒄𝒖𝒔𝒂𝒕𝒊𝒐𝒏 𝒐𝒇 ‘𝒅𝒆𝒏𝒊𝒂𝒍 𝒐𝒇 𝒉𝒖𝒎𝒂𝒏 𝒓𝒊𝒈𝒉𝒕𝒔’ - and that if Angola and South Africa were precedent cases, then there would be no easy way that the U.S. could escape being censured, right on its own home ground.”

On November 29, 1964, Malcolm X stated,

“𝒀𝒐𝒖 𝒂𝒏𝒅 𝑰 𝒎𝒖𝒔𝒕 𝒕𝒂𝒌𝒆 𝒕𝒉𝒊𝒔 𝒈𝒐𝒗𝒆𝒓𝒏𝒎𝒆𝒏𝒕 𝒃𝒆𝒇𝒐𝒓𝒆 𝒂 𝒘𝒐𝒓𝒍𝒅 𝒇𝒐𝒓𝒖𝒎 and show the world that this government has absolutely failed in its duty toward us.”

Finally, Malcolm X mentioned the United Nations topic for the last time on February 16, 1965, just days before his death. stating,

“as long as you call it civil rights your only allies can be the people in the next community, many of who are responsible for your grievance. But when you call it human rights it becomes international. 𝑨𝒏𝒅 𝒕𝒉𝒆𝒏 𝒚𝒐𝒖 𝒄𝒂𝒏 𝒕𝒂𝒌𝒆 𝒚𝒐𝒖𝒓 𝒕𝒓𝒐𝒖𝒃𝒍𝒆𝒔 𝒕𝒐 𝒕𝒉𝒆 𝑾𝒐𝒓𝒍𝒅 𝑪𝒐𝒖𝒓𝒕. You can take them before the world. And anybody anywhere on this earth can become your ally.” A few days later, Malcolm X was killed.
